Is lead paint always dangerous?
Only when it deteriorates — flaking, peeling, chalking, or generating dust at friction surfaces (windows, doors). Intact, well-maintained painted surfaces in pre-1978 homes are low-risk for adults. Children under 6 face the highest danger because they hand-mouth and absorb 4-5× more lead per dose.
Encapsulation vs removal — which to choose?
Encapsulation ($1-4/sqft): permanent disclosure required, but adequate for non-friction surfaces. Removal ($10-30/sqft): eliminates lead, no future disclosure. For families with young children, removal of windows + doors is strongly recommended; other surfaces can be safely encapsulated.
What does federal disclosure law require?
For any pre-1978 home sale: (1) The seller must give the EPA lead pamphlet, (2) disclose any known lead testing results, (3) the buyer must have 10 days to test for lead. Buyer's right to test cannot be waived. Sellers face $11K+ fines per violation.
Will mortgage lenders refuse pre-1978 homes?
